TERMS OF USE

1. OBJECT AND GENERAL INFORMATION

These Conditions of Use (hereinafter, the “Conditions”), together with other particular conditions that may be established, have as their object the website www.tipografiacommerciale.com (hereinafter, the “Website”), as well as the conditions of purchase of the items through the same. These conditions also include any sub-domains or third-level domains associated with typografiacommerciale.com

The Website is the property of Tipografia Commerciale S.R.L. — R.E.A. To 763498 – Reg. Imp. To 2678/91 – P.IVA 05000560013, whose domicile is located in Via Emilia 10 10078 Venaria Reale (TURIN) (hereinafter, “Tipografia Commerciale”).

The use of the Website’s services, as well as the purchase of any of the items offered, presupposes acceptance by the Customer or User, without reservations of any kind, of each and every one of these Conditions. Registration on the Website and use of the services means that your data as a User becomes part of the Tipografia Commerciale archives, and their processing will comply with the provisions of the Privacy Policy, which the User expressly declares to be aware of. and accept.

Tipografia Commerciale provides information on the items and offers the possibility of purchasing them through the Website. Those who wish to purchase the products must complete the relevant registration form which precedes the purchase process and follow the steps that Tipografia Commerciale will indicate through the Website.

These Conditions, together with the Privacy Policy and the Legal Notice of the Website are the only conditions applicable during the use of the Website and purchases of items through the same and replace any other conditions. Consequently, the User who accesses the Website, who registers and purchases items through the Website, agrees to submit to and remains bound by the Conditions, the Privacy Policy and the Legal Notice as they are drawn up at the time in which you access the Website. Anyone registering on the Website must be at least eighteen (18) years old.

2. INFORMATION ABOUT THE ITEMS

The photographs, graphic or iconographic representations, videos relating to Commercial Typography articles, as well as commercial names, brands or distinctive signs of any kind contained in the Website have the aim of providing as much information as possible. However, the User must keep in mind that they are for guidance purposes and, consequently, lack an exhaustive nature. Tipografia Commerciale reserves the right to select, at any time, the products offered to Users through the Website. In this way, Tipografia Commerciale may at any time add new products to those already present on the Website. It is to be understood that, unless otherwise provision, such new products will be governed by what is indicated in the Conditions in force at that time.

Likewise, Tipografia Commerciale reserves the right to terminate access, at any time and without notice, to any product among those offered on the Website.

In the event that, due to circumstances of force majeure, an item is no longer available after making the purchase, Tipografia Commerciale will inform the User via email of the total or, in this case, partial cancellation of the order. Partial cancellation of the order does not give the right to cancel the entire order, without prejudice to the exercise of the right of termination which is entitled to the User in accordance with the provisions of these Conditions.

3. PURCHASING SYSTEM

To proceed with the purchase of the item, the User, who must be over eighteen (18) years of age, must select the item he wishes to purchase and add it to the Cart. Once the selection of the items to be purchased has been completed, the User must click on the “Place order” button. Subsequently, the items selected for purchase will be indicated and the User must select one of the available options for shipping the items to the indicated address and the payment method for the same. Finally, the User must click on the “Complete order” button.

The data provided to Tipografia Commerciale through the corresponding form are elements of identification and qualification to access and make purchases and are personal and non-transferable.

4. DELIVERY TIMES

National shipments may take approximately 1 to 5 working days depending on the area from confirmation of payment by the Customer. Regarding international shipments, delivery times can vary from 5 to 15 working days, depending on the destination and the transport company indicated. Once the package has been delivered to the courier, the Customer will receive an email with the shipment tracking number. We will not be responsible for delays in delivery caused by the courier.

5. FORMS OF PAYMENT

The forms of payment accepted by Tipografia Commerciale are:

1. PAYPAL/CARD:

The Customer will be directed to the PayPal web page which will use its secure form of payment. Once the payment process is completed, you will be redirected back to the website.

On the PayPal page you can make the payment via PayPal account or by credit card. Under no circumstances will we accept payments by check.

PayPal may retain an amount as a deposit or insurance when you try to make a purchase with your card on the PayPal platform (usually equal to a few cents or €1). This amount will be refunded by PayPal within approximately one month. Payment of this amount does not guarantee that the purchase has been made.

2. MARKING:

Payment will be made upon delivery of the package, paying in the hands of the courier, in cash and with the exact amount. Under no circumstances will the goods be delivered without payment for the order.

3. BANK TRANSFER:

Payment will be made via bank transfer to the BANK data (IBAN) communicated electronically to the Customer during the order phase. The order paid by bank transfer will be processed upon confirmation of payment and therefore upon actual crediting of the amount communicated by the bank to Tipografia Commerciale.
For orders paid by bank transfer, delivery times may therefore vary by days relative to the actual crediting of the amount.

6. SHIPPING COSTS

6.1- GENERAL SHIPPING

– National Shipping – €12.20 + VAT up to 2.2 kg of goods

Over the specified maximum weight of 2.2 kg, €1.20 will be charged for each kg added to the package shipped. The weights of the packaged items can be checked on each item sheet under the heading “GROSS WEIGHT” which includes the net weight of the item + the weight of the packaging associated with it

At the moment there are no shipments outside of Italy

6.2- FREE SHIPPING COSTS
Free shipping costs may be activated for some areas or total order amounts on a promotional basis at the discretion (ways and times) of Tipografia Commerciale

7. OTHER FEATURES OF THE PURCHASE

1. Shipments are made via courier.

2. Shipping costs in any case include Value Added Tax (VAT), but no other duties, taxes, duties or surcharges.

3. Shipping means the delivery of the products to the home or direction specified by the Customer during the order process, limiting the delivery areas to those indicated above.

4. Tipografia Commerciale delivers the orders to the courier within a maximum of 48 hours. We are not responsible for possible delays in delivery caused by the courier.

8. REFUNDS

If the Customer has changed his mind or is not satisfied with his purchase, he can return it within 14 calendar days starting from the day he receives the items. To do this we only ask you to notify us in writing by email to info@tipografiacommerciale.com indicating the data necessary to locate the purchase. For our part, when we receive your email, we will notify you by email of receipt of the same, indicating the next steps to follow. In this case you must send us the items in perfect condition, a maximum of 14 calendar days after receiving the items. In this case Tipografia Commerciale will refund the customer all the costs of the original purchase. However, the customer will bear the direct cost of returning the items.

9. WARRANTY

All our items are covered by a six (6) month warranty in the event that the damage or defect is attributable to us. Therefore, if the item is found to be defective, Tipografia Commerciale will be responsible for collecting it and exchanging it for a correct one, bearing the costs associated with such exchange or return (with the exception of those additional costs deriving from having chosen an urgent delivery method; in this case the Customer will bear the extra costs).

In order to manage the inconvenience we need to be notified by email to info@tipografiacommerciale.com. It will be necessary to indicate: the reason for the inconvenience, the order number (essential to locate the purchase), the receipt of the same and the photos of the damaged or incorrect item so that the situation can be assessed. In order to exercise the warranty right, you will need to have proof of purchase or the receipt or invoice.

Once we have received this information we will contact the Customer to explain the steps to follow. He must inform us of the lack of conformity of the article within five (5) days from the moment he notices the imperfection.

In the event that it is not objectively possible to replace the item with another of the same category, Tipografia Commerciale will refund the price of the same.

It is important that you know that our guarantee does not cover:

a) Negligent or violent use of the item.

b) Damage resulting from manipulation or tampering with the item.

10. TAXES

The prices in any case include the Value Added Tax (VAT), but no other taxes, duties, duties or surcharges.

11. PRICES

The items will be sold at the indicated price, the price indicated at the time of confirmation of the order by the customer being in force.

12. VALIDITY

Tipografia Commerciale reserves the right to modify prices, articles, offers and other commercial conditions without notice.

13. WAIVER

Tipografia Commerciale’s failure to ensure that the User strictly complies with some of the obligations assumed by the User under a contract or these Conditions, or Tipografia Commerciale’s failure to exercise the rights or actions that we may correspond by virtue of this contract or the Conditions, will not imply any waiver or limitation in relation to the aforementioned rights or actions nor will it exempt the User from complying with such obligations. No waiver by Tipografia Commerciale of a concrete right or action will imply a waiver of other rights or actions deriving from a contract or the Conditions. No waiver by Tipografia Commerciale of any of these Conditions or of rights or actions deriving from a contract will be effective, unless it is expressly established that it is a waiver and is formalized and communicated in writing to the User.

14. MODIFICATION OF THE CONDITIONS

Tipografia Commerciale reserves the right to review and modify these Conditions at any time. The User will be subject to the policy and Conditions in force at the time he uses the web page or places an order, except in the event that by law or decision of government bodies Tipografia Commerciale must make retroactive changes to these Conditions . In this case, the possible changes will also concern orders previously placed by the User.

15. COMPLAINTS, COMMENTS, SUGGESTIONS

We provide customers with a complaints form which can be requested by writing to info@tipografiacommerciale.com

Likewise, any doubts, suggestions or comments can be addressed to our Customer Service department by email to info@tipografiacommerciale.com.

16. WEB USE

The Customer undertakes to use this web page exclusively to carry out legally valid research or orders and not to carry out any false or fraudulent orders. Otherwise we will be authorized to cancel it and inform the competent authorities.

The User must not make any prohibited use of this website. This includes, among other things, the intentional introduction of viruses, Trojans or any technologically harmful material.

We will not be responsible for any damage or loss that may be suffered by your computer as a result of the above actions, or your use of this web page or the downloading of content from it or to which it redirects you.

17. LINKS TO OTHER WEB PAGES

Our web page contains links to other web pages, social networks and third party materials. These links are offered for information purposes only and Tipografia Commerciale does not have control over the contents of such web pages or materials. Consequently, Tipografia Commerciale will not be liable for damages or losses resulting from the use of these links or third-party materials.

18. RESPONSIBILITY

Tipografia Commerciale is not responsible for delays in the delivery of orders and the impossibility of carrying them out in the event that the cause is attributable to an event of force majeure and therefore beyond our control. Among the various causes, we believe that force majeure exists in the following cases, but without limitation: accidents; strikes; riots, threats or terrorist attacks; fire or explosion; meteorological causes or natural disasters such as storm, flood, earthquake, shipwreck, epidemic; problems not attributable to us in means of transport or telecommunications systems. To the extent possible, once the cause of impossibility or delay has ended, Tipografia Commerciale will do everything possible to resume its commercial activities and be able to meet its obligations and shipments.

19. DATA PROTECTION

When you purchase our items or visit our web page from your computer, tablet or phone, you can authorize us to use your personal information. All information that comes into our possession is confidential. For the purposes of Organic Law 15/1999 of 13 December on the Protection of Personal Data (LOPD), Tipografia Commerciale is the entity responsible for collecting such information. We will process your data in accordance with the LOPD and other applicable laws. We will guarantee that the information is collected in compliance with all necessary security measures. 20. APPLICABLE LAW AND JURISDICTION

These Conditions are governed by and interpreted on the basis of Italian law. In the event that any type of disagreement or complaint occurs between the parties in relation to the compliance or content of these Conditions, the parties agree to submit the resolution of the case to the competent Judges and Courts of the City of Turin.
